Reform, don't abolish, the California death penalty

In November, California voters will choose whether or not the state?s death penalty will be abolished. The measure is called SAFE California and it will completely do away with the death penalty and all death row inmates will inherit life without parole sentences. This means that serial killers like Charles Manson, Sirhan Sirhan and Richard Ramirez (?The Night Stalker?) will be able to live the rest of their lives behind bars instead of pay for their actions.

This ballot measure seems all too familiar as the death penalty in California has been in question before. In 1972, three years after Sirhan was sentenced to death by the gas chamber, the famous lawsuit People v. Anderson ruled that the death penalty was a form of cruel and unusual punishment. This resulted in both Sirhan's and Manson's death sentences to be commuted to a life sentence. Because of the lawsuit and Proposition 7 in 1978, no executions performed in California until 1992 when?Robert Alton Harris was given the option of a brand new punishment known as lethal injection, which became the default method over the gas chamber in 1994. February 2006 proved to be another roadblock for the death penalty as U.S. District Court Judge Jeremy D. Fogel blocked the execution of serial killer Michael Morales because of claims that lethal injection was not administered correctly causing the subject to feel pain, deeming it cruel and unusual. The U.S. 9th Circuit Court of Appeals ruled that lethal injection must now be carried out by a legally authorized medical technician.

Since that February, there have been no executions and only 13 since 1978. For 83 other death row inmates from 1978- present, their death came before execution by way of natural causes, suicide and "other" causes. This makes a great case for the death penalty to be eliminated. Instead of elimination, reformation would be the way to go so the possibility of people like Manson can be done away with permanently.

SAFE California claims that abolishing the death penalty will save the state billions of dollars. On the contrary, removing the death penalty will not save the state much money, but reforming the appeals process will. The appeals process in California has four steps:

  • Automatic appeal
  • State Habeas Corpus
  • Federal Habeas Corpus
  • U.S. Supreme Court

Removing two steps from this process would allow the appeals process to move quicker and save the state loads of money. Shortening the appeals process to the two state appeals would be the ideal way to go, keeping a California issue within the state. The Los Angeles Times wrote a piece in 2008 asking to reform the appeals process. Writer Ronald M. George suggests that the appeals in the California Supreme Court be spread out to the?six appellate court districts to help take a load off of the Supreme Court. George also claims that this would guarantee significantly more high court review of capital cases than currently under the federal death penalty system. Keeping the death penalty at the state level will save time and money, and the executions will be quicker and in larger quantity per year. With this shorter appeals process, monsters like "The Night Stalker" will not be allowed to breathe ?free air? for much longer.

Brave | Arts & Entertainment | South Philly Review

Princess Merida (voiced by Kelly Macdonald) in Pixar?s ?Brave? shows girls that they can shoot a bow and arrow, too.

It may be clearer than ever that Pixar?s golden era went out with ?Toy Story 3,? the jewel in the crown of an animation studio that ruled over its medium for 15 glorious years. But does ?Brave,? Pixar?s new badass-Scottish-lass adventure, deserve to be flogged simply because it?s not ?WALL?E?-level transcendent? Yes and no. Solid yet innocuous, moving yet minimally ambitious, this old-fashioned fantasy is an oxymoronic specimen, aiming for progressiveness while clinging to safe traditions. But it nevertheless offers something rarely seen in the world of toons: A mother-daughter tale that leaves the boys on the side.

Merida (voiced by Kelly Macdonald) is your typical oppressed tomboy princess, a nervy athlete who?d rather fire arrows than follow the rules of her mother (voiced by Emma Thompson), a stern queen trying to marry Merida off. Before you can say ?Mulan,? our free-thinking heroine is pulling an Ariel, consulting a shady witch to ?change her fate.? What results is as zanily random as it is intentionally gender-subverting, and when not inducing yawns with lazy plot offshoots (the male characters simply holler and spar), the combo yields tender common ground for its feuding kinswomen.

Directed by Pixar?s Mark Andrews and Brenda Chapman, ?Brave? follows Disney?s ?Tangled? as a film in which hair proves a benchmark in animation?s evolution (Merida?s springy, scarlet locks are wondrous to behold). But, more importantly, the movie boasts Pixar?s first female lead, a separate benchmark many will view as a blown opportunity.

Andrews and Chapman may pilot their film to an affecting resolution, but their introductory scene of Merida triumphantly scaling a mountain (one of many moments with misty vistas), is hardly a promise that?s kept. ?Brave? is an atmospheric jaunt with quirky flourishes, but its bound to leave the gals in the audience feeling a bit shortchanged. Whereas, say, ?Up? presented a man with startling human complexity, Pixar?s unwittingly regressive 13th feature keeps things light and unchallenging, all while quietly waving a flag of feminism. Instead of passing women the ball, it merely throws them a bone.

Willem Dafoe fans shouldn?t miss the eco-drama ?The Hunter,? which sees the chameleonic actor take the lead as a sharp-shooting mercenary, tasked to hunt down an endangered animal in Tasmania. Shot on location, the film is predominantly picturesque, and it ably blends environmental themes with taut conflict. Its scattered missteps are overshadowed by Dafoe, who gives a soulful performance as the noirish antihero.

    PFT: NFL players say Rodgers is No. 1

    Packers quarterback Aaron Rodgers is the best player in the NFL, according to a vote of his fellow players.

    Rodgers was revealed as the pick for No. 1 on NFL Network?s Top 100 show, which surveyed NFL players and asked them to name the best in their ranks. Rodgers? selection was widely expected, as he?s the reigning league MVP.

    Saints quarterback Drew Brees was, as expected No. 2. In something of a surprise, Lions receiver Calvin Johnson was voted the third-best player in the NFL, ahead of Patriots quarterback Tom Brady, who was No. 1 last year but slipped to No. 4 this year.

    Jets cornerback Darrelle Revis was the highest-ranking defensive player on the list, improving from No. 8 last year to No. 5 this year.

    MACDONALD: Family history makes me sad that Safe Grad may be ...

    My dad loved to fish.

    He fished so much that in almost every childhood pic?ture I possess, I?m either laid out, hold?ing or standing beside one shimmery rainbow trout or another. (Oh, how he loved the fight in a big, old trout.) As a wee kid, apparently, I was close enough in size to a trophy fish that I was often used as proof of just how big Dad?s prize catches truly were.

    When my gentle, troubled dad died in 2000, we tacked a small Gone Fishin? sign to his coffin. My father?s heaven, you see, is a quiet realm of trees and lakes and rivers, a place that allows a man ample opportunity to paddle about in a canoe.

    These days, when I think about Dad, I always ? it?s funny how such odd little things can stick with a person ? find myself thinking about a scene in the 1993 movie Mrs. Doubtfire, the one in which Euphegenia matter-of-factly explains her husband?s death by stat?ing, ?He was quite fond of the drink. It was the drink that killed him."

    Given all this, Father?s Day may not seem the best day for me to write about an alcohol-related community issue.

    Nonetheless, as I have no father to visit on this special day and, therefore, a few spare hours to fill, it?s what I?m doing.

    A recent headline in The Chronicle Herald ? Popularity of Safe Grads on decline: Alcohol plays bigger role among today?s Grade 12 students in N.S. ? was, for obvious reasons, quick to grab my attention.

    The article explained how Safe Grad parties, which have historically been held (usually after the official prom) to give high school graduates the opportu?nity to celebrate in a safe, supervised and alcohol-free environment, are being held less and less often due to lack of interest.

    Only six of the 15 high schools in the Halifax regional school board district are holding Safe Grad functions this year. Also, it seems that many high school graduates feel they require ? or deserve ? alcohol to celebrate proper?ly.

    Before I go further, I?m going to let the school board off the hook and say that nobody within or affiliated with the school system is responsible for how teenagers choose to celebrate graduation.

    Although sad, I can understand why so many schools are choosing to let go of the Safe Grad concept, and can only admire all the teachers, students and parent volunteers who continue to stick with it.

    However, if a graduate chooses to opt out and instead head out after prom for an all-nighter graduation booze fest in the woods ? or to a parent-sanctioned party in a private home or a hotel room ? there is absolutely nothing any of them can do about that.

    I don?t even want to think about what the world will be like, and what I will be able to do, when my own boys graduate high school in a few years time.

    At this point, I can only hope that there will be a Safe Grad for them to attend. And then, if there is, I can only hope that they will choose to do so.

    To that end, and because I do believe that most of what kids need to learn is best learned within the home, I now find myself doing all that I can to equip my sons with a few useful tools that may (I can only pray and hope) help them to make good decisions about drinking and alcohol.

    I am educating them, challenging them, disciplining them, limiting them, and yes, letting them go.

    In addition to all this, I talk to them often about my dad ? about how he lived, and how he died.

    And every so often, just so that they never forget, I mention just how much I regret that they never got the chance to go fishing with their grandfather.

    Saudis to permit women to compete in Olympics

    LONDON (AP) ? A month before the London Games, Saudi Arabia appears to be moving closer to sending female athletes to the Olympics for the first time amid mounting pressure on the ultraconservative Muslim kingdom to grant women more rights.

    Deliberations by Saudi officials on sending women to the games have been wrapped in secrecy for fear of a backlash from the powerful religious establishment within a deeply traditional society, in which women are severely restricted in public life and are not even allowed to drive.

    Saudi Arabia is one of three countries that have never included women in their Olympic teams, along with Qatar and Brunei. The International Olympic Committee said talks have been ongoing with Saudi Arabia to ensure participation and a statement by the country's embassy in London said female athletes, who qualify, could be allowed to participate.

    "The Kingdom of Saudi Arabia is looking forward to its complete participation in the London 2012 Olympic Games through the Saudi Arabian Olympic Committee, which will oversee the participation of women athletes who can qualify for the games," the statement said.

    Human Rights Watch said the announcement is "an important step forward," but the New York-based group cautioned that gender discrimination in the country remains "institutional and entrenched."

    "It is only right that the Saudi government should play by the Olympic rules," Minky Worden, director of global initiatives at Human Rights Watch, said. "But an 11th-hour change of course to avoid a ban does not alter the dismal and unequal conditions for women and girls in Saudi Arabia."

    There are no written laws that ban or restrict women from participating in sport in Saudi Arabia, home to Islam's holiest shrines. The stigma of female athletes is rooted in conservative traditions and religious views which hold that giving freedom of movement to women would make them vulnerable to sin.

    Saudi officials have been sending mixed signals for months. While some said that they had been working on an arrangement with the IOC, top sports officials in the kingdom were adamant in publicly denying the possibility of female athletes competing at the Olympics.

    Saudi Olympic Committee president Prince Nawaf said in April that female participation had not been approved by the country's leaders and that Saudi-based women traveling to London would be contrary to the country's traditions and norms.

    Nawaf left open the possibility of Saudi women who are studying abroad being able to compete outside of the team as independent athletes. However, that option was quashed after pressure from human rights groups and the IOC.

    On Monday, a Saudi official said an announcement by King Abdullah about Saudi women's participation in the Olympics was expected some days ago, but was postponed after the death of Crown Prince Nayef.

    King Abdullah has taken modest steps to reform and modernize the oil-rich nation since he ascended the throne in 2005. He has faced staunch opposition from the hardline members of the royal family on each proposal he's made toward easing restrictions on women.

    Saudi women bear the brunt of their nation's deeply conservative values. They are often the target of unwanted attention from the kingdom's religious police, who enforce a rigid interpretation of Islamic Shariah law on the streets and public places like shopping malls and university campuses.

    Women do participate in sports in the kingdom, including clandestine soccer and basketball leagues. There are no national competitions, however, that would allow Saudi women to compete in order to qualify for international events.

    If the Saudis do send women to the games, then female athletes in judo and in track and field are considered possibilities for the games, sports officials familiar with the negotiations told The Associated Press while speaking on condition of anonymity.

    Because Saudi women may not meet the international qualifying standards, the IOC may grant them Olympic entry based on "special circumstances," an IOC official told the AP in March, adding that the IOC has insisted on more than one woman on the Saudi team, and hopes for at least two or three.

    Saudi officials have repeatedly hinted they'd allow equestrian Dalma Rushdi Malhas, who won a bronze medal in showjumping at the 2010 Youth Olympics in Singapore, to compete at the London Games. But the International Equestrian Federation said Monday the 20-year-old athlete will not be competing at the Olympics because she has failed to achieve "the minimum eligibility standard required for the Olympic Games" by June 17.

    Malhas' horse was sidelined by injury and missed a month's work during the qualifying period, the federation said in a statement.

    IOC President Jacques Rogge has said he is "optimistic" that Saudi Arabia will send women athletes, but last month said any deal was far from complete. Describing talks with Saudi Arabia as "not an easy situation," Rogge said discussions were under way with Saudi Olympic authorities and with athletes themselves.

    Qatar and Brunei are expected to include women, according to the IOC. If some arrangement can be made for the Saudis, all national Olympic committees in London would include women athletes for the first time in Olympic history.

    About 10,500 athletes are expected to compete in London, representing more than 200 national Olympic committees.

    Tutorial: How to use iMovie on the iPad | jeadigitalmedia.org

    Editing video on the go with the iPad and iMovie is pretty simple. Below I?ve grabbed three different free tutorials from Youtube that show you how to use the app. While the tutorials can give you a good of how to use the app, they are free so there are some limitations. If you are looking for really good, thorough tutorials on everything from iMovie to WordPress, I?d recommend subscribing to Lynda.com. These are a good starting point for you though if you?ve never seen iMovie on the iPad.

    iMovie is $4.99 in the App Store and well worth the cost.

    Heat wave unabated in North India, two dead

    Two persons succumbed to sunstroke in Uttar Pradesh as most parts of the northern plains simmered at temperatures above normal, even as some places witnessed light showers.


    In the national capital Delhi, the maximum temperature settled at 42.4 degrees Celsius, five notches above normal, while the minimum touched 32.4 degrees Celsius, four degrees above normal.

    Two persons succumbed to sunstroke in Prabudh Nagar district in western Uttar Pradesh, even as the eastern part of the state heaved a sigh of relief as moderate showers lashed parts of the region.

    While the day temperature rose appreciably in Gorakhpur division, it fell in Varanasi, Allahabad, Lucknow, Bareilly, Moradabad and Kanpur divisions.

    The highest maximum temperature in the state was recorded in Etawah at 44.2 degrees Celsius.

    There was no let up in the heat wave in Rajasthan as well, with Churu sizzling at a maximum of 43.5 degrees Celsius, followed by SriGanganagar at 42 degrees, according to the MeT department.

    Jaipur, Bikaner and Jaisalmer recorded maximums of 41.7, 41.3 and 40.5 degrees Celsius and other places recorded day temperatures between 35.7 degrees and 40.1 degrees Celsius.

    Hot and humid conditions gripped Punjab, Haryana and Chandigarh as well, with day temperatures settling at up to five degrees above normal.

    Amritsar was the hottest place in Punjab at 43.4 degrees Celsius, five notches above normal, while in Haryana, Hisar recorded the highest maximum temperature at 43.5 degrees Celsius, three notches above normal.

    Chandigarh recorded a high of 40.1 degrees Celsius, three degrees above normal.

    The day temperatures at most places in the two states, including Bhiwani, Karnal, Narnaul and Rohtak in Haryana and Ludhiana and Patiala in Punjab were above 40 degrees Celsius.

    Palestinians push UNESCO to make Bethlehem's Nativity church a World Heritage site (Ha'aretz)

    The Church of the Nativity in Bethlehem is becoming the church of contention, with a bid by the Palestinians to use their position as the newest members of the UN's cultural arm to obtain World Heritage status for the iconic Christian site - and perhaps boost their own campaign for legitimacy.

    The effort by the Palestinian Authority, like its overall efforts for global recognition for an independent Palestinian state, is drawing resistance. And it may fail at the World Heritage Committee meeting that starts Sunday.

    An experts committee has turned down the emergency bid to quickly confer on the Church of the Nativity, and its pilgrimage route, the status as an endangered World Heritage site, saying the application needs more work. Even custodians of the holy site, the Greek Orthodox, Roman Catholic and Armenian churches are opposed, according to a document obtained by The Associated Press.

    The church - which drew some 2 million visitors last year and parts of which are 1,500 years old - stands above the grotto that Christians believe was the birthplace of Jesus. The Palestinians' application asks for recognition as a site of "outstanding universal value" urgently in need of attention.

    There is concern by the United States and others that the Bethlehem holy site and the integrity of the World Heritage process risk falling victim to the politics that for decades have torn the region asunder, with the Palestinians using their foothold in the UN system to grab symbolic recognition of their elusive bid for statehood in a long-disputed land.

    The World Heritage candidacy of the Church of the Nativity and the pilgrimage route is one way for the Palestinians to prove they are responsible stewards of the site which draws tourists the world over. Above all, it is part of a broader attempt by Palestinian President Mahmoud Abbas to seek international recognition for a state of Palestine after its controversial backdoor entry into the UN system.

    Negotiations with Israel on the terms of a Palestinian state have been frozen in recent years, mainly because Abbas and Israeli Prime Minister Benjamin Netanyahu, have failed to reach enough common ground for meaningful talks.

    Meantime, Abbas has tried to create new leverage, including with a quest for UN membership for a state of Palestine in the West Bank, Gaza and East Jerusalem, the territories Israel took control of in the 1967 Six-Day War. The UN bid has been stalled for months, but Abbas hopes to garner recognition for Palestine wherever possible, including with a nod from UNESCO for Bethlehem.

    Angry at Palestinian membership in UNESCO, the United States pulled its $80 million in annual dues - 22 percent of the overall budget - from the Paris-based organization after the October vote that made the Palestinians the 195th member.
    Bucking the bad feedback, the Palestinians refused to follow UNESCO custom and withdraw the candidacy - as the French did with their emergency bid for the Chauvet cave, with its hundreds of prehistoric drawings, when it got a negative recommendation from the experts.

    The Palestinians now risk losing face at the World Heritage Committee meeting from Sunday until July 6 in Saint Petersburg, Russia, when 33 sites from around the world will be considered for the coveted World Heritage status.

    A surprise thumbs up could feed rancor and rivalries in a volatile region, within the church itself and perhaps at the UN Educational, Scientific and Cultural Organization.

    Already, the Palestinian ambassador to UNESCO, Elias Sanbar, has denounced a "persistent campaign of rumors" at the organization.

    Protecting the cultures of the world is among UNESCO's core missions and there is little doubt the Church of the Nativity - with a longstanding problem of leaks from the roof - is in need of repair. A program administered by the Palestinians is already in progress.

    Located in the West Bank, it is managed by three churches, each jealous of its role as custodian of the site, defined under an agreement dating back to the Ottoman Empire.

    With a big measure of diplomacy, the leaders of the Greek Orthodox, Catholic and Armenian churches rebuffed the Palestinian proposal, politely reserving judgment on its reasons.

    "In our opinion, we do not think it opportune to deal with this request that the Basilica and its entire complex be included in the list of World Heritage sites, due to different considerations," read a letter to Abbas signed by the three leaders. A copy of the letter was obtained by The Associated Press.

    Among other things, a World Heritage designation raises fears that the delicate arrangement of custodianship might be disturbed. Fights among priests using broomsticks have been known to break out in the past over a perception that boundaries are being overstepped.

    "When it comes to the Church of the Nativity, no one can interfere," said Yousef Daher of the World Council of Churches in Jerusalem. "They (the Palestinian Authority) figured it wrong." He called the Palestinian bid a "surprising request."
    "A church is a church, it shouldn't become a world heritage. It's a sacred place and its ownership is not for anyone," Daher said.

    The Palestinian emergency application cites lack of regular restoration on the church due to the political situation since 1967 when Israel took control of the territories and difficulties procuring equipment because of lack of free movement imposed by Israeli forces.

    Israel turned much of Bethlehem over to the Palestinian Authority in the 1990s.

    The U.S. State Department did not hide its disapproval of the Palestinians' emergency bid.

    "We are disappointed by the Palestinians' intention to push through an emergency inscription against the recommendation of UNESCO's own experts and without thoroughly consulting all stakeholders," a statement said. It made clear that Washington's objection stems from the rush job that an emergency candidacy implies and which prevents a full review including by those with a stake in the outcome.

    "We hope the Committee will act responsibly as good stewards of the World Heritage Convention, rather than allowing yet another UN forum to become a victim of politicization," the U.S.? statement said. "The site is sacred to all Christians."

    An experts report, conducted for UNESCO by the Rome-based International Council on Monuments and Sites, which reviews all applications, concluded that the Palestinians failed to show that damage or dangers to the Church of the Nativity "make its condition an emergency that needs to be addressed - for immediate action necessary for the survival of the property."

    It suggests the application be resubmitted under normal procedures with fuller detail. That takes about 18 months, meaning it could be re-nominated in 2014.
    "Palestinians are continuing with their bid, and they are still hopeful and optimistic that they will succeed," said Palestinian government spokesman Ghassan Khatib. He declined to elaborate.

    The Palestinian delegation to UNESCO refused any comment until after the Saint Petersburg meeting. However, a letter circulating among delegations suggested a plot was afoot.

    In a letter, Ambassador Sanbar denounced a campaign of pressure against the bid from "those who do not want to see Palestine exercise its legitimate rights."

    The June 11 letter, a copy of which was obtained by The Associated Press, included what is purported to be a statement of support for Palestinian leader Abbas signed in type by the Roman Catholic and Greek Orthodox leaders, noting the Armenian was absent.

    That letter "gave some delegations the impression that the churches had changed their opinion and were no longer opposed to the inscription," said one UNESCO official. "Was it designed for that purpose? I don't know."

    The official asked not to be identified because of the sensitivity surrounding the Palestinian bid.
